Welcome to the DrivAd Inc website. By using this website, you accept the Terms & Conditions of this Visitor Agreement in full. Please read this agreement carefully.

ARTICLE I - TERMS AND CONDITIONS OF USE

1. General Provisions
The Web is an evolving medium. DrivAd may change the terms of this agreement from time to time. By continuing to use this website and following our posting of such changes, you agree to be bound by the entire terms of this agreement, as modified. DrivAd may change, restrict access to, suspend, or discontinue this website, or any portion of this website, at any time without prior notice to its users.

The material that appears on the DrivAd website is for informational purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. Before purchasing goods or services you've read about on the DrivAd website, you should confirm with competent legal or marketing advisers any information that is important to your enrollment and agreement decision. DrivAd is not responsible for, and does not guarantee the performance or even reception of, any such goods or services incentives awarded to the selected drivers.

We invite you to bring to our attention any material on our site that you believe to be inaccurate. Please forward a copy of said material to our customer service manager along with an explanation of your objection. We will do our best to look into the issue.

2. Conditions for Enrollment
Most drivers are eligible for enrollment into the DrivAd database. However, prior to filling out an enrollment form, please be advised that DrivAd requires that all drivers initially meet the following criteria:

• Have a valid driver’s license with satisfactory driving record.
• Be a minimum of 18 years old.
• Provide proof of ownership of vehicle.
• Be prepared to sign a waiver for selected vehicles.
• Maintain the vehicle in satisfactory condition
• Keep vehicle clean at all times throughout duration of the DrivAd campaign.
• Inform your insurance company that your vehicle has advertising decals installed.
• Operate and park the vehicle legally at all times during the DrivAd campaign.
• Indemnify DrivAd and the advertisers against all claims, actions or suits as a result of the advertising decals.
• Sign a contract outlining the terms, conditions and responsibilities of all parties.
• Inform DrivAd in the event of damage to the advertising decals.
• Agree to meet with a certified DrivAd affiliates at least once a month for decal, vehicle and mileage inspection.
• Allow DrivAd to remove the decals at the end of the campaign and if required at any time without prior notice throughout the duration of a campaign.

Any and all other terms and conditions agreed to by DrivAd and yourself upon execution of a valid DrivAd enrollment form

The information maintained in this website is provided for informational and sales purposes only. It is not intended to constitute or substitute for the marketing, sales or legal advice by a qualified practitioner. It is suggested that users consult other sources and consult directly with a professional advisor when seeking advertising advice.

For your convenience, we might from time to time make available a variety of links to other websites which are independent of DrivAd where you can obtain related products and services. Although we encourage you to consult such websites, we cannot guarantee the prices, terms, quality, reliability or performance of the products or services provided by these vendors. DrivAd is not responsible for the products or services these vendors provide. You release and hold harmless DrivAd and its affiliates or subsidiaries from any and all damages that you may incur, and agree not to assert any claims against DrivAd, it’s affiliates or subsidiaries, arising from your purchase or use of third-party supplied products and services.

5. Ownership and Permissions
DrivAd is made available for your personal and/or commercial use. The materials on this site are the property of DrivAd or its licensors, and are protected by U.S. and international conventions. Except as explicitly provided in this agreement, you may not distribute, transmit, display, reproduce, modify, create derivative works from, or otherwise exploit any of the materials on this site. You may display and occasionally print a single copy of any page on the site for your personal, non-commercial use, but you may not otherwise reproduce any material appearing on this site without the prior written consent of the owner. You may not store any significant portion of, nor distribute copies of, materials found on this site, in any form (including electronic form), without prior written permission from the owner.

You are free to establish a hypertext link to this site so long as the link does not state or imply any endorsement or sponsorship of you, your company, or your site by DrivAd, its subsidiaries or any of its affiliates. You will not use DrivAd to violate the copyright, trademark, or other intellectual property rights of any person or other entity. By submitting material to DrivAd you are permanently granting DrivAd all rights to the material, including the right to modify the material, to use it commercially, and to maintain the material in an archive.

7. Registration
To obtain access to certain DrivAd services, you will be given an opportunity to register with DrivAd. As part of the registration process, you will select a user name and a password. You agree that the information you supply during that registration process will be accurate and complete and that you will not register under the name of, nor attempt to enter the service under the name of, another person or entity. We reserve the right to disallow, suspend or terminate use of user name that we deem offensive or inappropriate. You will be responsible for preserving the confidentiality of your password and for all actions of persons accessing DrivAd through any username/password assigned to you. You will notify DrivAd’s customer service manager of any known or suspected unauthorized use of your account.

8 . Miscellaneous
No spamming or data scrapping. We want potential drivers, installers and/or advertisers visiting DrivAd to feel free to share their email addresses with those listing goods or services for sale on our site or contributing to our Board postings. By participating in the services available through this site, you agree to use the email addresses of those responding to your listing only for purposes of communicating with them about the potential sale of goods or services or responding to their Board posting. By using this website, you agree not to use information concerning other users of DrivAd, or the goods/services or information they've listed or searched for on this website (including listing information, user names, email addresses, telephone numbers, and/or other information), for any purpose other than to explore the potential purchase or sale of listed goods or services.

This Visitor Agreement has been made in, and will be construed in accordance with the laws of, the State of California. By using this website, you consent to the exclusive jurisdiction and venue of the state and federal courts in San Jose, CA in all disputes arising out of or relating to this Agreement or use of this website.

10. Personally Provided Information

This includes but is not limited to the use of information for inviting you to participate in one of our campaigns or to provide you with regular updates regarding our Program. We do not give, share, sell, or transfer any personal information to a third party companies outside of DrivAd partners unless required by law.

13. Security
For site security purposes and to ensure that this service remains available to all users, we use software programs to monitor traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. Causing damage to computer systems is a violation of U.S. law and is subject to criminal prosecution in federal and/or state court. In the event of authorized law enforcement investigations, and pursuant to any required legal process, information from these sources may be used to help identify an individual.

DrivAd maintains the security of your information at all times. Our site is using the Secure Socket Layer (SSL) protocol with 128-bit encryption strength to transmit sensitive information. This is the same technology used in transmitting sensitive information by banks, governments, and online Fortune 100 companies.

Once the information is in our system, it is only accessible to authorized DrivAd personnel. We strictly enforce our privacy policies with our employees and any breach of this policy will result in termination and the pressing of criminal charges where there are grounds.
